Smoking restrictions in enclosed public places

The Tobacco Products Control Regulations 2006 (external site) made under the Tobacco Products Control Act 2006 (external site) prohibits (bans) smoking in or around all enclosed public places, including those on licensed premises (places where alcohol can be legally sold).

These regulations apply to public premises including:

• shopping centres
• theatres and cinemas
• airports
• cafes and restaurants
• pubs, bars and night clubs
• sporting clubs
• public transport including buses, trains and taxis.

These laws aim to reduce community exposure to second-hand smoke. Numerous scientific studies have shown that exposure to second-hand smoke causes or promotes a number of illnesses and diseases, including lung cancer and heart disease.

Outdoor smoking bans

Smoking is banned in the following outdoor public places:

• in outdoor eating areas where people eat or drink sitting at tables.
• between the flags at patrolled beaches
• within 10 metres of any children’s playground equipment
• in or on a vehicle where a child under 17 is present
